What Makes a Government Legitimate
Four foundational principles — the ground every clause that follows is built on.
The Right to Rule
“The legitimacy of government is derived exclusively from the consent of the governed.”
A government’s authority comes only from the people it governs — never from force, wealth, lineage, or divine claim. Where that consent is absent, the government holds no rightful power.
Legitimacy Tests
“Legitimate Governments are and ought to be designed in such a way as to minimize consent violations, balance interests uniformly, and govern effectively. “
Legitimacy is not a yes-or-no label but a design goal, measured three ways: how rarely a government overrides people’s consent, how evenly it weighs everyone’s interests instead of a favored few, and how capably it actually governs.
Basic Structure Doctrine
“A Fair Constitution describes Rights and Responsibilities of Individuals and Governments that must exist for a Legitimate Government to exist.”
A Fair Constitution is not a wish-list. It names the specific rights and responsibilities — of individuals and of governments alike — that must already be in place for any government to count as legitimate.
Self-Evident Entrenchment
“It is observed to be entrenched in the laws of nature and is therefore immutable.”
These foundations are not granted by an authority that could later revoke them. They are treated as inherent in the nature of things, and so cannot be amended, suspended, or bargained away.
